All purchases by you of services or products from the Site are subject to these Terms of Use and the Terms and Conditions applicable to the provision of our serices ("the Terms and Conditions"). If there is any conflict between the provisions of the Terms and Conditions and these Terms of Use then the Terms and Conditions will prevail to the extent of any inconsistency.

Any account numbers, passwords and user names issued to account holders are collectively referred to as "ID". You are responsible for maintaining the security and confidentiality of your ID and remain responsible for all uses of your ID and any costs associated with your ID whether authorised by you or not. All intellectual property rights in all the materials contained in the Site, the software and products available for download from the Site and the data collected by the Site (the "Content") including but not limited to patents, copyright, database right and trademarks belong to us or our licensors.

Warranty and Liability

Notwithstanding the provisions of this Section, our liability is not limited in the case of death or personal injury directly caused by our negligence.

Other Matters
If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this notice, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.

These terms shall be governed by, and construed in accordance with, English law. You agree that the Courts of England shall have exclusive jurisdiction to settle any dispute that may arise out of, under, or in connection with these terms.

We may make changes to any part of the Site or the Content (including these terms) at any time. We will notify you of any changes to these terms by including then below under the heading "Changes to Terms". By using the Site after the date of any change you are agreeing to the changes. If you do not agree to any changes you should not use the Site after the date of the changes that you do not accept. If you are a business user, ceasing to use this Site under this section does not (i) constitute termination of the Terms and Conditions and/or (ii) release you from any continuing obligations under the Terms and Conditions.
