Experian Limited provides comparison services for financial products and a service which enables you to obtain advice or assistance from a third-party adviser. These terms cover your use of Experian’s consumer products, services, and websites. You accept these Terms & Conditions by using the services and/or continuing to use the services after a change to the Terms. We may amend these Terms & Conditions from time to time without notice. You should therefore read them each time you use our services.

If you misuse our services or breach any of these Terms & Conditions, then your right to use the services will cease immediately. By using our services or agreeing to these terms, you agree to our collection and use of your data as described in the Experian Partner Marketplace Services Privacy Policy. Using our services

Our comparison services provided by Experian Limited allow you to research and compare financial products that may be available to you depending on your circumstances. The services are designed to help you make the most of your money, but it is not, and should not be construed as, financial or other professional advice. In our various product comparison journeys, we may feature several providers. We do not recommend one provider over another, and these areas are not intended to be an exhaustive list of all providers of a particular financial product. It is up to you to decide whether what they offer is right for you. If you are at all unsure if a product is right for you, you should seek professional advice.

Our comparison services are free for you to use. We may receive a fee and/or commission from the third-party product provider when you use our services to purchase products or services from them.

Additionally, we may offer services which enables you to obtain advice or assistance from a third-party adviser away from our site (either via a third-party website or over the telephone). We do not charge you any fees for these services. We may receive a fee and/or commission from the third party to whom we refer you.

Experian Limited has no control over the third-party providers listed in our comparison services. So, Experian Limited specifically refuses all liability for any damage or costs of any type arising out of or in any way connected with your use of a provider's service or product included in our comparison services. We recommend that you read and understand any terms and conditions relating to a specific product or service before you enter a contract with your chosen product provider.

The product data and financial technology are from Experian Limited. We make every effort to ensure that the data provided by the services is correct. However, we rely on a wide variety of sources and other websites. We believe these sources of data to be correct and dependable, but sometimes they may not be. Experian Limited makes no claims or representations as to the accuracy, completeness, or truth of any material contained on our sites. Experian Limited is not liable for any errors or delays in the content or transmission of the data on our sites.

Where Experian Limited provides a "whole of market" service, the aim is to provide a fair reflection of the marketplace. It is not always possible to provide data for every product in the market. Certain product characteristics, such as geographic restrictions or unusual features, mean that some products are excluded to prevent confusion.

Our content

The content includes several trademarks (including Experian) that are owned by us or our licensors. By making the trademarks available on our websites, we are not giving you any permission to use them. You can view and display the content on a computer screen, print individual pages on paper or make a reasonable number of photocopies (or both) and store the content in electronic form on your computer's hard drive for your personal, non-commercial use only.

Conduct

You agree to use comparison services provided by Experian Limited for lawful purposes only. You may not: use, or allow others to use, to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or entity; intentionally violate the laws, rules, and regulations of the Financial Conduct Authority and the national or other securities exchanges; intentionally violate any other applicable law or regulation while accessing and using our sites or collect or store personal data about other site users. Whilst we cannot review all transmissions by our site users, Experian Limited reserves the right to monitor any information transmitted or received through our service.

Indemnification

You agree to indemnify, defend, and hold harmless Experian Limited, affiliates, directors, officers, and employees from and against any claim, liability, cost, damage, or loss we may incur (including, without limitation, solicitors' fees) because of any violation by you of your obligations under these Terms & Conditions.

Disclaimer of warranties and liability

Experian Limited cannot and does not warrant the completeness or accuracy of the information or other content found on our sites or its usefulness for any particular purpose. You understand and acknowledge that information posted by third party providers are the sole responsibility of the person from which such material originated. Experian Limited takes no responsibility for the accuracy and completeness of the information posted in our site areas including our product comparison journeys.

You agree that Experian Limited shall not be liable for any decision made or action taken by you, or others based upon reliance on information, or any material published by Experian Limited.

All information provided on Experian Limited’s websites is to be used on an 'as is, with all faults' basis. We make no promises that our content or the service itself will be delivered to you uninterrupted, secure, error-free or delivered on time. We are not making any promises or warranties except that we will not intentionally lie to you. Other than that, we reserve the right to be wrong. This means that you agree that under no circumstances shall Experian Limited be liable for any direct, indirect, incidental or any other type of loss or injury resulting from your use or downloading of any content on our sites. This includes, but is not limited to, loss or injury caused by contingencies beyond our control in creating or delivering any part of Experian Limited. Linking to our services

You may link to our pages or services, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. However, you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists. Other matters

If any provision in the Terms & Conditions is invalid or unenforceable, the remaining provisions will continue in full force and effect. The laws of England and Wales shall govern the Terms & Conditions as if it were a contract entered into and performed within England. The courts of England and Wales shall have exclusive authority in relation to any disputes arising under or in connection with the Terms & Conditions, but without prejudice to Experian Limited's ability to bring proceedings against a user in the courts of any authority.

Do not attempt to use our services through any other interface other than that provided. You may only use our services as allowed by law and we may withdraw the services from you if we are investigating suspected misconduct.

Any use of our services does not imply the transfer of intellectual property rights or content that may be accessed. You may not use or transfer content from our services without permission. You may not obstruct, remove, or change legal and regulatory notices displayed throughout the services.

Acceptable conduct

By agreeing to the Terms & Conditions, you agree to use our services for your personal, non-commercial, and lawful purposes, that you will not engage in any activity that is harmful or infringes our rights or the rights of others, and that you will treat our staff with respect.

Fraud

If we suspect that you provide false data or detect fraudulent activity, we will record it and we reserve the right to pass it to the police or other fraud prevention agencies.

Our obligations to you

We will provide the services to you with reasonable skill and care, and we will obtain and provide the information we make available to you through the services with reasonable skill and care. We do not guarantee the information we receive from third parties (including the details you provide) is accurate, complete, or up to date.

If we fail to comply with these terms or do not use reasonable care and skill when providing the services to you, we are responsible for foreseeable losses or damages that you incur. Loss or damage is foreseeable if, it would have been expected by you or us, at the time the contract was made.

We are not responsible for loss or damage suffered by you as result of:

  • circumstances beyond our reasonable control; (for example, industrial action taken by third parties or network or system failure of one of our data providers) but only where we have taken reasonable steps to prevent or minimise any impact on the services
  • any business losses that you incur, (we supply our services for domestic use only)
  • false, inaccurate, or incomplete information provided by you
  • any information provided to you by a third party or any issues arising out of your access or purchase of any separate third-party product or service, including whether they are suitable for you (unless we have specifically told you we are providing you with advice to take out the third party product or service, or advised you to take a particular course of action, which was not suitable and as a result you suffer loss).

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, and any liability under the Financial Services and Markets Act 2000 or the Payment Services Regulations 2017 or for breach of your legal rights in the provision of our services. You can ask us to repeat and fix a service or get some money back if we cannot fix it, in the event our services are not conducted with reasonable care and skill. This is a summary of your legal rights, there may be others available to you. If you need more information about these rights, you can contact your local Citizens Advice Bureau.

Customer Service and Complaints

We will always aim to provide you with the best service possible. However, occasionally we may not live up to your expectations. If you feel our service could have been better, we would like to know so we can make sure it does not happen again - either to you or to anyone else.

Hopefully, we will be able to resolve your complaint to your satisfaction. If, however, anything is unclear or you are unhappy with our response, please contact the person that managed your complaint. They will do all they can to answer your questions and reach an agreement.

Updates to the services or the Terms & Conditions

Our contact with you for the services does not have a fixed time. In future we may need to update these Terms & Conditions. The reasons we need to make changes are:

Minor Changes

  • To make administrative changes or general improvements. For example, to change our contract information, how we handle complaints, to update ombudsman information, to make our Terms & Conditions easier to read or to correct typographical errors.
  • To comply with legal requirements. For example, new law may oblige us to include specific information in our contract with you.
  • To improve the security processes or procedures of the service.

Service changes

  • Our services rely on us checking data, which is provided to us by third parties. These third parties may change the data they provide, stop providing it altogether or change their contract with us to oblige us to include information in our contract with you.
  • If we make technical improvements to the services or we may wish to improve how we make the Service available to you.
  • If we make any changes to these Terms & Conditions, we will tell you what has changed through the website where our services are delivered.
